June 30 the Verkhovna Rada adopted in first reading the draft Town
Planning Code, which establishes the general legal and
institutional framework for planning and building of territories in
Ukraine.
In particular, the Code provides that the territories would be subject to special state regulation of activities in the field of planning and development areas include lands recreational purposes, the territory of historical ranges populated areas, border areas, land defense, territory and objects of nature reserve fund water protection zones and coastal shelterbelts, and other areas of environmental purposes, the territory of the future development of transport and utilities infrastructure, interstate and national significance, and areas of natural and manmade.
Urban Planning Code also stipulates that the architectural and town-planning council is formed by the decision of the Council of Ministers of Crimea, regional, Kyiv, Sevastopol urban, regional state administrations, executive bodies of the city council. It is a deliberative body, acting on a voluntary basis. Not allowed collection of funds from customers (developers) and project developers in preparing for the review and consideration of such projects at a meeting of Architecture and Town Planning Council. Mandatory consideration at the meeting shall be gradsoveta town planning documentation, architectural projects, and architectural objects, located in historic downtown, in historic habitats, projects high-rise buildings.
For a professional collegial discussion of planning, architectural and engineering solutions projects the most important sites of urban planning and architecture, as well as appropriate justification for urban conditions and restrictions of building individual plots of land in the central organ of executive power on matters of construction, urban planning and architecture formed the highest architectural and town-planning council .
The bill also provides for a General Plan of planning the territory of Ukraine for 20 years. The central executive authority on construction, civil engineering and architecture annually monitor the implementation of the General Scheme of planning the territory of Ukraine for those approved in the prescribed manner, and gives the Cabinet of Ministers a report on its implementation as of January 1 this year.
